Jack Daniel’s gets Supreme Court showdown against dog toy maker

 


WASHINGTON (CN) — The Supreme Court agreed Monday to wade into a trademark dispute concerning whiskey and poop-themed dog toys. 

VIP Products sells a Bad Spaniels Silly Squeaker dog toy labeled “The Old No. 2 on your Tennessee carpet.” Though shaped like a bottle of the iconic Jack Daniel’s Tennessee whiskey “Old No. 7. Brand,” Bad Spaniels touts its contents as “43% Poo by Vol.” and “100% Smelly.” The problem is Jack Daniel’s isn’t laughing. 

Represented by Williams & Connolly, Jack Daniel’s says the Bad Spaniels toy infringes on its trademark and prevents the brand from protecting its image. The whiskey company said trademark law “does not account for VIP’s purported First Amendment interest in making poop-themed jokes at Jack Daniel’s expense.”

Philosophical Question #14 – Lifestyle Choices

Here is an interesting question in my list of philosophical questions: 1.) Should governments have penalties for those who live unhealthy lifestyles? A list of unhealthy lifestyles would include things like smoking, drinking, illegal drugs, prostitution, and other “vice” type activities. I guess the “government penalties” would be referring to monetary punishments, withholding medical treatments (insurance companies would love that), possibly imposing/regulating very high (exorbitant) prices on things considered unhealthy in order to cut down on their use, and other possibilities. 2.) Or, would you say that living an unhealthy lifestyle, likely resulting in a LOT of eventual personal pain and suffering, should be punishment enough for unhealthy lifestyles? When people make bad choices in life, often in their youth where ignorance and immediate gratification takes them over,  3.)
